Jane works for a small business which is struggling financially. Because of the company’s financial situation, employees are not permitted to work overtime. A large order comes in, and Jane works a total of 45 hours in one week. Her supervisor instructs her not to work overtime, and informs her that the company simply cannot afford for her to do so. “Don’t worry about it”, Jane states, “I am a team player and want the company to succeed. I am volunteering the extra time and do not expect to be paid for it.” Later, she changes her mind and demands to be paid for five hours of overtime. Must the company pay Jane the overtime? Why or why not?
