Question 1

Steven works as a parts distribution salesman for Conventina Motors and is provided with a company car for driving to the various garages in his sales area. Although Conventina Motors has a well-publicised policy prohibiting staff from carrying passengers in company vehicles, Steven sometimes gives Nigel, a student on work placement, a lift home from work.

Steven was leaving work early one evening to make a delivery of car parts to a customer on his way home, when he agreed that Nigel could accompany him to make the delivery and then continue the journey home.

Nigel helped Steven to carry car parts into the customer’s showroom. Steven drove at high speed on the return journey and the car crashed. Steven was uninjured in the accident. However, Nigel suffered serious injuries and is claiming in negligence against Conventina Motors.

Advise Conventina Motors as to its liability in tort (if any) to Nigel. (50 marks)

Question 2

Elizabeth is a trainee sales consultant at Conventina Motors. She has a disabled father who suffers from epilepsy and multiple sclerosis. Her father’s condition has worsened recently and she went to see her line manager, Tariq, and asked whether she can work flexi-time.

Tariq told her that she cannot work flexi-time because of the heavy workload in the department. Elizabeth is upset about this and started to cry as she left Tariq’s office. Robert, the senior partner of the firm, saw Elizabeth and put his arms round her. He told her that if she turns up in his office tomorrow in a see-through shirt and short skirt, she may be able to work flexi-time. Robert put his arms round her at last year’s office Christmas party.

Advise Elizabeth whether she can bring any claims against Conventina Motors. (50 marks)
