One of the distinguishing characteristics of the prosecutor, especially at the state level, is the enormous and broad discretion given to the office. The authority of a contemporary prosecutor to issue charges has been described as “the broadest and least regulated power in American criminal law”. (Gershman 1993, 513). That discretion is tempered by very little. As you learn about prosecutors it is important to keep in mind this distinguishing characteristic of the office.
For this part of the assignment let’s take a look at the office of prosecutor in the federal system.
