Legal Aspect in construction

Brown’s construction company, which is minority owned, has been in business for over forty five years. They have a work crew of over 75 workers. Ninety five percent of the work crew are minorities which include African American, Mexican and Dominican. Brown’s construction company is known for their exceptional work ethic, timely project completion and excellent workmanship. Approximately 80 percentage of its workers have over 10 years of experience in construction mainly in the areas of building hotels, shopping malls, bridges and hospitals. They are also state certified in their trades. This company is responsive and responsible. They have completed projects valued $50 million dollars on many occasions. We have certified and experience electrician, plumbers, mason, dry wall workers, and roofers, heavy, Equipment operators, truck drivers, and architect. They are fully equipped with all the construction tools and equipment needed to complete jobs that value 50-55 million dollars. In their 45 year existence they have not had a dissatisfied customer. All the job that have been done by Brown’s construction company received many praises and recommendation from their many satisfied customers.
State of New Jersey was seeking to build a new state owned bus terminal in Paterson, Passaic county New Jersey. They received 6 bids for this project. The bids ranged from 25 – 28 million dollars. Brown’s Construction bid was 25 million. The contract was given to Parisi Construction who bid 26 million dollars. Parisi construction is non-minority owned with a 100% Caucasian workforce.
Brown Construction was disappointed and felt that they were discriminated against since they presented the lowest bid. They believed racial bias was the reason that they did not win the project. Browns Construction company filed a law suit claiming discrimination and bias.
