Part A

Scenario:

On 1 October, Barry, a second year law student at Sherwood University, placed an advertisement on the law school notice board stating:

“Amazing bargain offer! A full set of first year law books at half price. Will go to the first person to notify me of their intention to purchase by 4 October at the address supplied in this advertisement”

Sally, a first year law student saw the advertisement and posted a letter to Barry on 1 October. The letter said, “Will buy your books. I assume you will take a cheque?” Unfortunately, Sally omitted the postcode from the address and the letter did not arrive until 5 October.

Another first year student, Amrit, having seen the advertisement, dropped a note signifying his intention to purchase through Barry’s letter box on his way to the law school on 2 October. The note landed on a highly polished hall floor and slid under the table where it lay unseen by Barry until 4 October.

On the night of 2 October, in the Union Bar, Barry negotiated a sale of the books to Kevin at the full price. Kevin had not seen Barry’s advertisement. On 3 October, Sally and Amrit were informed of this sale by Jack, the college porter, a person well-known for getting things muddled.

On 4 October Kevin saw Barry’s advertisement and claimed back half the money he had paid to Barry for the books.

Questions:

Using suitable legal authority and good reasoning, answer the questions below based on the above scenario:

1. Is there a contract between Barry and Sally?
2. Is there a contract between Barry and Amrit?
3. Is there a contract between Barry and Kevin?
4. Can Kevin claim half the purchase price back based on the advertisement?

Scenario:

Belinda went to the local train station in order to travel into Sherwood city centre. The trains were owned and operated by Sherwood Rapid Transit Plc. Belinda had often travelled on the company’s trains in the past on her way into the city.

In order to obtain a ticket, Belinda inserted some coins into an automatic machine and the machine issued a ticket. On the face of the ticket appeared the words, “Issued subject to the company’s conditions of carriage.” A sign displaying the conditions of carriage was normally displayed adjacent to the machine but it had been temporarily removed pending refurbishment of the station.

Belinda went down a flight of steps to the platform where there was displayed a notice headed “Conditions of Carriage”. One of these conditions stated:

“The liability of the company or its servants for loss or damage is limited to the sum of £75.”

Belinda boarded the train. Owing to the negligence of the train driver, when the train arrived at its destination, it was involved in a minor collision. Belinda fell over and suffered injuries. Belinda’s new digital camera, worth £400, was damaged beyond repair.

Advise Belinda.
